Proceedings of the Meeting

On 28-03-2009,the members of the Association assembled and with an objective of maintaining the Apartment and to fulfill the protection and needs of the residents there and with a view to achieve the objective of equality, brotherhood etc amongst the residents of the buildings, all the residents of the building assembled and unanimously elected the members of the Managing Committee and Bye Laws of the association by name and style ”ALPINE ECPAPARTMENT OWNERS WELFARE ASSOCIATION” was prepared as per the Karnataka Societies Act and was placed before the meeting and the General Secretary of the Association was authorized to correspond with the officers and the Registrar of Societies in this regard .a decision was taken to register this Association in the office of the Registrar as per the Karnataka Registration of Societies Act. In that respect the objectives and Bye laws of the Association was prepared and submitted.

Memorandum

1.Obejective of the Association

A. Responding to the grievances of the residents of the Apartment and bringing such problems to the notice of the concerned officers and striving hard to solve the same.

B. Creating highest opinion like equality, brotherhood, peace and co-existence etc amongst the residents of the Apartment.

C. Correspond with the concerned officers regarding the basic amenities that are available from the Government and other Department to the residents of the Apartment.

D. To maintain cleanliness in the Apartment.

E. Arranging meetings, conference and symposiums of the residents of the Apartment.

F. Correspond with the concerned officers regarding the maintenance e of the water, road, street light, bus facility and maintenance of park coming under the Area of the Apartment.

G. Celebrating national and local festivals every year.

H. To develop sportive and cultural attitude in the residents of the Apartment, encourage indoor and outdoor sports like carom, chess, snooker, billiards, cricket, volleyball, hockey, etc and chalking out cultural programmers.

I. Arranging free medical checkup, eye testing and blood donation camps, enlighten about the first aid.

J. Conserving the environment around the Apartment.

K. Chalking out programmes which are helpful to the residents of the apartment.

L. Chalking out all type of programmes necessary for the knowledge of the present youths.

O. Chalking out programmes regarding protecting Public Interest, protection from fire, first aid, pulse polio etc.

2.The amount accrued in the association shall be used for the development of the association and for no reason be distributed amount amongst the members.

Bye Laws of the Association

These Bye laws have been framed with a view to fulfill the objectives mentioned in the memorandum of Association.

1. Name of the Association and Applicability

A. These Rules and Regulations be called as the Bye laws of the Alpine Eco Apartment Owners Welfare
Association.

B. The provisions of these Bye laws are applicable only to the Alpine Eco Apartment Owners Welfare
Association.

C. The owners, tenants, future tenants or its employees or any other persons utilizing the facilities of this
Building presently or in future are bound by the Rules and Regulations contained in this Bye laws.
Mere taking on rent or license, or on lease any Apartment in the Alpine Eco apartment Building
Complex, it shall be deemed that they have accepted and ratified these bye laws and follow the same.

D. It is the duty of the owner (or his authorized representative)to bring these bye laws to the notice of
the tenant/person who has been authorized by him to reside in his building and as a proof of
accepting these bye laws shall obtain his signature to the Rules and Regulations of this Alpine Eco
apartment Owners Welfare Association.

2.Name and Address

3.Definitions

A. Act : means the Karnataka Registration of societies Act 1960 and Rules made there under.

B. The Building and including building, including one or more rooms or space enclosure

(or a part or a part thereof) in the building called Alpine Eco Apartment Owners Welfare

Association means a part of the property intended for independent use of any kind.

C. The Association means the Alpine Eco Apartment Owners Welfare Association.

D. ‘Building’ means the building located at the address Sy.No. 13,

Doddanekkundi village, Krishnarajapuram Hobli, Bangalore East Taluk,Bangalore-560037.

E. ‘Deemed Member’ means any person who is the occupant of an Apartment with the consent
of the owner. .

F. Managing Committee means the Managing Committee of the Alpine Eco Apartment Owners
Welfare association.

G. Members means.

As stated above membership means the owner who has paid the membership fee or in his absence such person including the resident of alpine Eco apartment or the deemed Tenant or Occupant as per the Bye Laws of the Association.

H. Occupant means, including the mortgage, tenant or license who has occupancy of any
apartment with the consent of the concerned owner.

I. Owner means a person or persons, who has ownership of undivided interest of Apartment and Common Areas and amenities.

J. Terrace means Terrace at the top of the building.

K. For the words or utterances used in these bye law, unless otherwise required in the context,
shall have the same meaning as assigned to them in the Act.

4.Members of the Association

A. All the persons who purchase in the Alpine Eco Apartment Owners Association Building and
become Owners, automatically become the of the Association. If an apartment is purchased
From a company, trust, H.U.F firm etc, the Director or Managing Trustee who has been
authorized by the concerned organization, shall be the member. The membership shall not
exceed the number of Individual Apartments. For the purpose of membership the family/HUF
/Firm, Association of persons shall be treated as a one unit. However, if one Family/HUF
/firm, persons, other Association has the ownership of more than one Apartment, then/they
/it/he can have membership in accordance with the number of Apartments possessed.

B. If two or more persons jointly purchase an Apartment, they will have joint right to the
Apartment. But the one decided by them and failing to intimate the General secretary of the
Association within 90 days from the date of purchase, the first owner will be the member
of the Apartment. However, the first Joint owner at any time by writing a letter may request
to change his name to any other Joint owners. Only the person whose name has been found
in the Register of Joint owners have right to vote and represent in the election. The joint
owner whose name has been found in the Register of Members, may authorize any Joint
owner to vote or to participate. Once , such delegation is made by the authority letter given,
he looses all his right on infavour of whom he has delegated.

C. If the member are married the husband/wife may be deemed as members.

D. If an owner of an apartment of alpine Eco apartment has let out to a person/party or permitted
a person/party to reside in it, such resident shall be subjected to the bye laws and regulations
of the alpine Eco apartment Owners Welfare Association and the rental agreement shall contain
a clause, in this regard.

Therefore , for every meeting of the Alpine eco apartment Owners Welfare Association,
unless such voting right is delegated to him by the owner, such residents will be deemed
members of the Association, without voting rights.

E. If any owner sold his Apartment or completely alienated by way of Gift, will or by any other mode, the
Purchaser, who got by will or gift will automatically become members of the Association. But they
have to pay Transfer Fee.

F. In case of Change of ownership of the Apartment, the member who transfers shall submit a copy of
document and return the membership card and arrears, if any has to be paid to the General Secretary
of the Association.

G. Only after completion of the above formalities, the membership shall be transferred to the purchaser
Member.

H. If there are any arrears in respect of the Apartments, the same has to be paid by the Purchaser-
member.

I. When a member dies his/her membership shall be transferred to the one he/she has request through
will or will in accordance with law or to the legal representative of his property. In case he has not
made any specific request, as the case may be the name or names of his Legal heirs shall be mentioned
in the register of the owners of the Apartment. If such legal heir or the one who acquired right by
WILL is minor, the name of the guardian shall be named. If there are more than one Legal Representatives then for such cases, the clause (B) shall be applied and all the legal heirs shall be considered
as Joint Owners.

J. If any owner in arrears of his service charge, subscription to the Maintenance Fund or any other arrear
s for more than three months as on the last date of the year, shall not have right to exercise vote for
the selection of Managing Committee Member and any other office bearers or will not have right to
contest to such post.

5.Cessation of Membership

A. Those who ceases to own an apartment in the Building complex.

B. Those who have failed to pay the service changes or maintenance charges or subscription to the
Association for three months and after 15days even after issue of notice.

C. The conduct and character of whose is antisocial and /or detrimental/injurious to the Association
and its welfare in the opinion of the Managing Committee.

D. The membership of any person that has been terminated under the clause6(B) or (c), may be given
admission again on the terms and conditions that would be appropriate in the opinion of the managing Committee. .

E. Where it is contemplated to remove any member under the above clause 6(C), regarding such propos
al he/she shall be served a notice in writing and he/she shall have right to present his/her defence
before the Managing Committee , and the decision of the Managing Committee shall be final and
such member shall be bound by that.

F. The person whose membership is terminated from the Association, in any manner whatsoever, will
loose all his interest of the funds or other properties belonging to the Association and will not have
right for the water being supplied by common water tank or source for him having the membership
of the association or for any other common amenities.

G. If for any reasons, the membership of the Association of any member is cancelled, then without prejudice to the rights of the Association, Association has right to take suitable action to recover all the
amount due from such defaulted member. Till such amount is recovered and/or any person claiming
under him, will not be entitled for using any common amenities provided.

6. Rights and Privileges of the members

A. The member shall have right to attend any Annual General Body Meeting and to exercise vote
on any motion and will have equal right to contest to the Managing Committee or to attend
the Annual General Body Meeting and exercise vote and shall have right nominate his
husband/wife, parents or adult son to contest the elections to the Managing committee.
The rights and privileges of the members are equal. Though having any number of Apartmen
-t, every member shall have only one vote.

B. Whenever a member is admitted, every person shall be supplied with a copy of bye laws, free
of cost. If requested for additional copies, on payment of such cost per copy or the fees that
may be prescribed by the Managing Committee from time to time, shall be supplied.

7.Sources of Funds

A. Service charges: In respect of each of the Apartments, each member or his authorized repair
sensitive, as the case be shall pay service charges or fixed service charges, this amount will be
reviewed temporarily by the Managing Committee or the Secretary and it will come into
effect only after obtaining the approval by the Managing Committee.

B. If any member of the Managing Committee absents himself for three meeting of the

Managing Committee meeting continuously without any valid reason, his membership of the

Managing Committee shall stand cancelled automatically and the vacancy so caused could be filled
in, by the Managing Committee. But the member whose membership has been so cancelled,
shall be given an opportunity to present himself before the meeting and adduce explanation
and if found satisfactory, he may continue as the member of the Managing Committee.

C. The day to day administration, maintenance of the Alpine Eco Apartment Owners Welfare
Association and all power required for the discipline shall rest with the Managing Committee.

D. All the questions that come up before the Managing Committee shall be decided by majority
of members present and if there is equal votes, the President shall have second vote or the
casting vote.

E. The Managing Committee can delegate any of its powers or for any special purposes may

constutute sub committee consisting of members of the Association whom it deems fit. The sub-
committee so constituted, shall be governed by any regulation that may be stipulated by the
Managing Committee, from time to time.

F. Co-Option: The Committee shall have power to co-opt two persons amongst its members or
from their families. The term of office of the members so co-opted, shall be coterminous with
the Managing Committee.

8.Utilisation of Funds

A. With the prior approval of general Body Meeting, the amount collected shall be

utilized for the following purposes:-

For the payment of salaries of the employees of the Alpine Eco Apartment Owners welfare Association and Service Providers(if any)
1.Electricity charges for the lifts and common lighting and pumps.

2.Gardening and maintenance of landscaping

3. Building Insurance and maintenance, contract of lifts and pumps, generators etc.

4. Stationary, postal charges and related office expenses.

5. Day to day maintenance of building including consumable articles.

6. Building security contract and cleaning contracts.

7. Expenditures as approved by the Managing Committee.

8. Library or Annual Subscription of dailies, magazines etc.

9. Annual Maintenance contract of lifts after the period of 12 months on proportionate rate.

B. The amount remitted to the Maintenance Fund Account, with the prior approval of
the Annual General Body Meeting shall be utilized for the regular maintenance of
major nature, as hereunder

1.Painting of common areas and it may consist of surface of the outer wall and roof
of the building.

Changing of water pumps, elevators and motors.
Reworking of the Landscaping, in a big way.
Repairs/Replacements required for the railing of the common area.
Repairs/Replacements of the covers of open shafts of the roof.
Repairs/Replacements of the covers of the drainage shafts.
Repairs of Drive ways.
Any other expenses ,that may be considered as maintenance by the Managing Committee.
C. The amount accrued by other charges levied by the Association, shall be utilized
for augmenting the service charge fund.

9.Maintenance Fund

A. As decided by the Annual General Body Meeting every member shall pay such amount to
Association as maintenance fee and the said fund shall be the corpus of the Association. As
and when decided at the Annual General Body Meeting all the members shall pay amount to
maintenance fund, as subscription. Apart from this out of the amount collected as Service
charge 15% shall go to the maintenance fund. Further the Annual General Body Meeting at
any time may charge the rate of subscription for any period.

B. Transfer Fee

Whenever the owner sell the apartment or completely alienate it by way of gift ,will or in o
other way whatsoever, the purchaser of the building or the recipient by way of gift,

automatically becomes the member of the association and he shall pay an amount by way of Transfer
fee to the Association as may be fixed by the Managing Committee from time to time.
the purchaser/recipient by way of Gift/who took by will has to pay the service taxes
applicable to a member, in these Bye laws

C. Date of Payment

1. The schedule for payment shall be as scheduled by the Managing Committee with the prior
approval of the Annual General body Meeting.

D. Mode of Payment

1. All the payments to Alpine Eco Apartment Owners Welfare Association shall be made in
cash or by way of crossed cheque/DD payable in the name of the Association.

2. Every owner of the building shall have a pass book and it shall contain the entries pertaining
to the amount paid towards maintenance fee, transfer fee and the amount paid as penalty
per month during the continuance of default. It the period of default exceeds more than three months, such defaulter, after completion of the said three months period, shall be deemed to have forfeited the right of amenities provided to him, for the reason of he being the member of the Association.

3. Except for the regular service charges for the amount payable for every Apartment, bill shall be issued. If the apartment is being used, the bill shall be issued to the owner, if not will be sent to last
postal address available with the Association. The Association shall maintain Proof for having
dispatched.

4. If a member fail to pay the regular service charges for a period of more than three months,
without prejudice to its right to recover the arrears, it will be lawful for the Association to
stop amenities including the water supply to the Apartment.

5. The occupant of the Apartment, will be responsible for paying all the arrears of the
Association.

10.Investment of Funds

Subject to the provisions of the Karnataka Registration of Societies Act, 1960, the Managing
Committee may invest the amount remained, as it deems proper, from time to time.

11.Bank Account

A. As decided by the Managing committee, shall open a Bank Account in the name of the Alpine Eco
Apartment Owners Welfare association in any of the Nationalized/Private/Co-operative/Schedule
Bank and the amount of the Association shall be remitted in such Bank and whenever the amount
is required for the works of Association, maybe drawn with the Joint signatures of the General
Secretary and the Treasurer of the association.

B. The Administration and Accounting year of the Association will be from the first of April till March
thirty First.

C. The Managing Committee shall appoint an Auditor and he shall not be the member of the Managing
Committee.

D. By appointing an Auditor the Assets and Liabilities of the Association, the Accounts of the Association
has to be prepared and the same shall be placed before the Annual General Body Meeting.

E. If any details regarding the Accounts of the Association, is required, any member can obtain the same
from the President or the General Secretary.

12. Obligations of the Building Members

Owners of every building shall be responsible to pay the arrears to the Association.
The members shall not use the Apartment other than the purpose of dwelling or in a way that cause breach to the privacy of other residents, in the opinion of the Managing Committee or in a way violating the honor of the building.
The owners of the shop premises shall not use their premises for any commercial activities in a way causing trouble to the residents. In this regard, the decision taken at the Annual General Body Meeting is final and the owners of the shops are bound by that.
If failing to undertake such work, if it could cause harm to the structures pertaining to other Apartment of the building, all the inside maintenance and repair works shall not be under taken secretly.
If due to the non performance of any obligation, that are to be performed by the member, any damage is caused to the common amenities that were provided in the building by such lapses, then in such a circumstances, the Association shall have right to undertake the required repairs and such expenses towards the repairs had to be reimbursed to the association, by the member.
At any time, whether the owner is present or not, in case of an emergency that has happened in that unit or that may cause trouble to it, the occupant shall give the right of admission to the Apartment to the members of the Managing committee or any other person authorized by the Managing Committee.
The member or the occupant shall not conduct/shall permit to conduct any activities which are detrimental to the interest of the co-occupants.
The owner/occupant shall not store/shall not permit to store any dangerous or objectionable materials that would ruin the peace and tranquility around the building or dangerous to the structure or construction of building.
The parking space shall be used only for parking vehicles of the members or the persons who have obtained power from the members as far as his parking space is concerned. The parking of vehicles is prohibited in the premises abutting it or for any other purpose.
Without the prior permission of the Managing Committee, any owner of the apartment or member of the association shall not undertake any repair, changes or modification of the space mentioned hereunder.
The works of changing the existing structures or that would cause damage to the apartments.
Any works that would cause damage to the building immediately or in future, in any way.
The works that would cause impediment to the common areas of the building or for the common amenities.
All major repairs to the Apartments has to be undertaken only after obtaining suitable approval from the Managing Committee or its authorized representative.
13.Common Areas and Amenities

The following Areas and Amenities in the building shall be deemed to be common to all members.

Staircase and stairways of the whole building.
Service road to the building and various Apartment.
The doorways and all open spaces inside the compound of the building.
Television cable network along with booster or dish antenna.
Bore wells along with motors, pumps etc
Elevator, pent house with respective elevator instrument on the roof of the building.
Elevator extended to the remaining stairs from the ground floor.
Water Tanks on the roof of the building.
Pumping equipment and plumbing network throughout the building.
Lights and water connections in common areas.
Electric wiring network throughout the building.
Required light, phone and water connections.
Basement, main walls, columns, girders, beams and terrace, gardens, pump houses of the building.
Vacant place and Landscaped space, garden and the rooms in it. Tank, pumps, metres, fans, fire extinguishing equipments, compressor ducts, central air conditioning and heating equipment and installations that are meant for the common use.
One Room for the use of generator.
Drive way at the entrance of the building.
Water processing plant and room, Association room and all oher common amenities/benefits.
Inter com equipment and network in the whole building.
Basement drive ways to parking bays.

14.Code of Conduct

Unless empowered by the Association no residents shall affix any kind of Advertisement or posters in or over the building.
The residents who rear pet and domestic animals shall follow the law, rules, regulations of sanitation of the Municipality. Without accompanied by some one, the pet animals are not allowed to go out. The cleaning excreta of the pet animals is the responsibility of its owner.
Putting garbage by the residents of the apartment outside the area earmarked for such purpose in the service area, is prohibited.
All the residents shall extend their co-operation regarding the security and protection of all the concerned and shall be bound by the Rules and Regulations framed from time to time in that regard and shall be in accordance with it.
All the residents shall use the water limitedly and shall not put the cloths for drying ,in common areas.
None of the residents shall use the services of the watch and ward staff and other employees of the Association, for their personal work.
It is suggested that the residents shall not have a quarrel with the employees of the Association /service Providers. If there are any complaints against any such employee/Service Provider ,shall bring such matter to the notice of the Secretary or any other persons specified by the association. He then will conduct enquiry and take necessary resident action.
The residents shall prevent their servants roaming in the common area or quarreling with other residents. All the residents shall be responsible for the conduct and discipline of their servants and except the common servants toilets provided in the building, the servants shall not use common amenities provided.
The residents, their family members, guests or children shall not play within the compound of the building, the reason is that there is likelihood of sputniks or other flying articles hitting the window glasses, cars, scooters or causing injuries to the persons.
The expenditure of damage caused to the building ,plants, vehicles, equipments or machines, pipes, electrical wiring by any negligence or willful act of the member or his family members, guests, children or servants, shall be paid by the member to the Association.
There is no provision to park the vehicles of the visitors inside the building.
Generally, shall conduct themselves in a way having good relationship with the members/residents, the neighbourers of the residents of Apartments and shall be a model of courtesy.
With the prior written permission of the Managing Committee, except on the special occasions like festival and marriage, no music be played in the common area and not to litter in the common area.
The residents shall be bound by the rules that may be framed from time to time by the Managing committee regarding the using of common amenities/utilities.

15.Amendment to Bye Law

For any Amendment to the bye law or regulation, when 2/3 member give their consent when tabled before the special General body Meeting , will have power to frame or alter not inconsistent with these and after the consent of the Register of Societies, could be adopted.

16.Time Limit for Notice by the member

A. The Members who intend to give notices regarding the proceedings of the Association and suggesting Amentment to the constitution, shall send the notice to the office of the Association at least 10days before the day fixed for the Annual General Body Meeting.

B. Preparing the Next year Budget Estimate, by the Managing Committee.

17. Quorum for the General Body Meeting

In every General Body Meeting Not less than 1/3 members shall be present. If in any meeting if this requisite number of members are not present within half of the stipulated time, that meeting shall be adjourned. Thy day, time of the adjourned meeting shall be fixed by the president and shall be intimated whether there is quorum or not. No new agenda shall be taken up for discussion in the adjourned meeting.

18. General Body Meeting

A. 21 days before the convening of the meeting The General Body Meeting shall be held within 03 months after completion of Financial Year i,e., within June month every year. Notices shall be sent to every member.

B. The Income and Expenditure Statement for the previous year prepared by the Chartered Accountant shall be discussed at the meeting and approved. The Association will review the progress achieved in that year.

c. Every year, in the General Body Meeting 07 number of Managing Committee members shall be elected. These elected members will elect president, Vice president, General Secretary, Joint Secretaries-2, TREASURER, Deputy Treasurer and Managing Committee Members amongst themselves and other will continue as the members of the Association. Presenting the budget for the next year.

19. The power of the member to exercise vote and become candidate

1. Only the members who have paid their subscription amount in full and whose names are included in the voters list will have power to participate in election to General Body Meeting and the Managing Committee.

2. THE VOTING IN THE General Body Meeting may be held by raise of hands or by secret voting, Every member who is present or the representative who is personally present will have power to exercise one vote only. Even if a person owns more than one Apartment, he will have power to exercise only one vote.

3. The member, himself can exercise vote being personally present or the representative who has been authorized by the member can exercise vote. The document appointing the Representative shall be in handwriting of the person who has appointed and shall be specific for every meeting.

4. If in respect of any Apartment failing to pay the service fees from time , other arrears ect as provided in this or any other amount due to the Association, till that default continue, the representative representing that villa, will not be having power to exercise vote .The Managing Committee may display the names of such members on the Notice board.

20. All decision shall be done by the majority of the members present. In case the amendment of the constitution of it the majority shall not be less than ¾ of members present.

21. Special General Body Meeting

Whenever the Managing Committee deems fit, it is necessary or whenever not less than 1/3 member eligible to vote request or on the order of the Registrar of Societies, within 30 days from the date of requisition , Special General Body Meeting shall be convened by giving at least 21 days of Prior to all the members. In the notice the place ,date time and agenda shall be mentioned. For the sole reason that some one had not received notice, the proceedings of the meeting, will not become void.

22. As soon as the year ended, the President, Secretary shall prepare Annual Accounts and get auditor duly authorized as per Section 296 of the Companies Act, 1960 and place before the General Body Meeting.

23. As per Section 13 of the Karnataka Registration of Societies Act, 1960 within 14 days of obtaining permission of the Annual General Accounts shall be sent to the Registering Officer.

24. Amendment

Taking action as per Section 9 and 10 of the Karnataka Registration of Societies Act1960, if necessary the Memorandum and the Bye Laws of the Association could be changed. Such Amendment will come into effect after obtaining permission from the Registering Officer.

25. Dissolution

By taking action as per section 22 and 23 of the Karnataka Registration of Societies Act, 1960, the Association could be dissolved.

26. Affiliation

By taking action as per Section 21 of Karnataka Registration of Societies Act 1960 may be amalgamated with any registered Association.

27. Power and Duties of the Office Bearers President

Will have power to convene all the concerned meeting, to convene Managing Committee to give guidance and supervise the business pertaining to the Association, to exercise casting vote. Will have power to convene Managing Committee Meeting in Special Circumstances.

Vice President

Assisting the President, in the works of the Association and in his absence perfoms the duties of that day.

General Secretary

The General Secretary will convene Managing Committee Meeting , Annual General Body Meeting and other meeting of the members, Will correspond with private, government, semi government organizations and the concerned department regarding the subjects decided at the Managing Committee. Recording the proceeding of the meeting, get the Accounts written, receive the proceeding of the meeting , get the Accounts written, receive the subscription , donation and gifts from the members, donors, private persons, government and semi government organizations.

To look after the financial transaction of the bank, to see that the accounts of Association are got recorded at the Register of societies from time to time every year and correspond with all the concerned department on behalf of the Association and after court, office affairs.

Joint Secretary

Receiving the General Secretary in the day to day affairs of the Association and in hs absence performing the duty of that day.

Treasurer

Receiving subscription, gift, donation, etc from the member, donors, organizations and issuing receipt to them. Remitting the amount so received to the Bank and handing over the receipt thereof to the President or General Secretary of the Association

28. General
A. The Singular used in this Bye Laws and Regulation shall include plural also and plural shall include singular also.

29. Regarding the provisions not specifically stated in these bye laws. Provisions contained in the Karnataka Registration of societies Act, 1960 and The Rules made there under shall apply.

30. Notice Board
The Association shall put up Notice Boards in front of the office and at the Main entrances of the Apartment for displaying the meeting notices, resolution, proceedings etc such notice board shall be deemed sufficient for serving of the notice.

1.Obejective of the Association
A. Responding to the grievances of the residents of the Apartment and bringing such problems to the notice of the concerned officers and striving hard to solve the same.
B. Creating highest opinion like equality, brotherhood, peace and co-existence etc amongst the residents of the Apartment.
C. Correspond with the concerned officers regarding the basic amenities that are available from the Government and other Department to the residents of the Apartment.
D. To maintain cleanliness in the Apartment.
E. Arranging meetings, conference and symposiums of the residents of the Apartment.
F. Correspond with the concerned officers regarding the maintenance e of the water, road, street light, bus facility and maintenance of park coming under the Area of the Apartment.
G. Celebrating national and local festivals every year.
H. To develop sportive and cultural attitude in the residents of the Apartment, encourage indoor and outdoor sports like carom, chess, snooker, billiards, cricket, volleyball, hockey, etc and chalking out cultural programmers.
I. Arranging free medical checkup, eye testing and blood donation camps, enlighten about the first aid.
J. Conserving the environment around the Apartment.
K. Chalking out programmes which are helpful to the residents of the apartment.
L. Chalking out all type of programmes necessary for the knowledge of the present youths.

Bye Laws of the Association
These Bye laws have been framed with a view to fulfill the objectives mentioned in the memorandum of Association.
1. Name of the Association and Applicability
A. These Rules and Regulations be called as the Bye laws of the Alpine Eco Apartment Owners Welfare
Association.
B. The provisions of these Bye laws are applicable only to the Alpine Eco Apartment Owners Welfare
Association.
C. The owners, tenants, future tenants or its employees or any other persons utilizing the facilities of this
Building presently or in future are bound by the Rules and Regulations contained in this Bye laws.
Mere taking on rent or license, or on lease any Apartment in the Alpine Eco apartment Building
Complex, it shall be deemed that they have accepted and ratified these bye laws and follow the same.
D. It is the duty of the owner (or his authorized representative)to bring these bye laws to the notice of
the tenant/person who has been authorized by him to reside in his building and as a proof of
accepting these bye laws shall obtain his signature to the Rules and Regulations of this Alpine Eco
apartment Owners Welfare Association.

3.Definitions
A. Act : means the Karnataka Registration of societies Act 1960 and Rules made there under.
B. The Building and including building, including one or more rooms or space enclosure
(or a part or a part thereof) in the building called Alpine Eco Apartment Owners Welfare
Association means a part of the property intended for independent use of any kind.
C. The Association means the Alpine Eco Apartment Owners Welfare Association.
D. ‘Building’ means the building located at the address Sy.No. 13,
Doddanekkundi village, Krishnarajapuram Hobli, Bangalore East Taluk,Bangalore-560037.
E. ‘Deemed Member’ means any person who is the occupant of an Apartment with the consent
of the owner. .
F. Managing Committee means the Managing Committee of the Alpine Eco Apartment Owners
Welfare association.
G. Members means.

1.Life Membership
As stated above membership means the owner who has paid the membership fee or in his absence such person including the resident of alpine Eco apartment or the deemed Tenant or Occupant as per the Bye Laws of the Association.
H. Occupant means, including the mortgage, tenant or license who has occupancy of any
apartment with the consent of the concerned owner.
I. Owner means a person or persons, who has ownership of undivided interest of Apartment and Common Areas and amenities.
J. Terrace means Terrace at the top of the building.
K. For the words or utterances used in these bye law, unless otherwise required in the context,
shall have the same meaning as assigned to them in the Act.
4.Members of the Association
A. All the persons who purchase in the Alpine Eco Apartment Owners Association Building and
become Owners, automatically become the of the Association. If an apartment is purchased
From a company, trust, H.U.F firm etc, the Director or Managing Trustee who has been
authorized by the concerned organization, shall be the member. The membership shall not
exceed the number of Individual Apartments. For the purpose of membership the family/HUF
/Firm, Association of persons shall be treated as a one unit. However, if one Family/HUF
/firm, persons, other Association has the ownership of more than one Apartment, then/they
/it/he can have membership in accordance with the number of Apartments possessed.

B. If two or more persons jointly purchase an Apartment, they will have joint right to the Apartment. But the one decided by them and failing to intimate the General secretary of the Association within 90 days from the date of purchase, the first owner will be the member
the Apartment. However, the first Joint owner at any time by writing a letter may request
to change his name to any other Joint owners. Only the person whose name has been found
in the Register of Joint owners have right to vote and represent in the election. The joint
owner whose name has been found in the Register of Members, may authorize any Joint
owner to vote or to participate. Once , such delegation is made by the authority letter given,
he looses all his right on infavour of whom he has delegated.
C. If the member are married the husband/wife may be deemed as members.
D. If an owner of an apartment of alpine Eco apartment has let out to a person/party or permitted a person/party to reside in it, such resident shall be subjected to the bye laws and regulations of the alpine Eco apartment Owners Welfare Association and the rental agreement shall contain a clause, in this regard.
Therefore , for every meeting of the Alpine eco apartment Owners Welfare Association, unless such voting right is delegated to him by the owner, such residents will be deemed members of the Association, without voting rights.

E. If any owner sold his Apartment or completely alienated by way of Gift, will or by any other mode, the Purchaser, who got by will or gift will automatically become members of the Association. But they have to pay Transfer Fee.
F. In case of Change of ownership of the Apartment, the member who transfers shall submit a copy of document and return the membership card and arrears, if any has to be paid to the General Secretary of the Association.
G. Only after completion of the above formalities, the membership shall be transferred to the purchaser Member.
H. If there are any arrears in respect of the Apartments, the same has to be paid by the Purchaser-member.
I. When a member dies his/her membership shall be transferred to the one he/she has request through will or will in accordance with law or to the legal representative of his property. In case he has not made any specific request, as the case may be the name or names of his Legal heirs shall be mentioned in the register of the owners of the Apartment. If such legal heir or the one who acquired right by WILL is minor, the name of the guardian shall be named. If there are more than one Legal Representatives then for such cases, the clause (B) shall be applied and all the legal heirs shall be considered as Joint Owners.
J. If any owner in arrears of his service charge, subscription to the Maintenance Fund or any other arrears for more than three months as on the last date of the year, shall not have right to exercise vote for the selection of Managing Committee Member and any other office bearers or will not have right to contest to such post.

5.Cessation of Membership
A. Those who ceases to own an apartment in the Building complex.
B. Those who have failed to pay the service changes or maintenance charges or subscription to the Association for three months and after 15days even after issue of notice.
C. The conduct and character of whose is antisocial and /or detrimental/injurious to the Association and its welfare in the opinion of the Managing Committee.
D. The membership of any person that has been terminated under the clause6(B) or (c), may be given admission again on the terms and conditions that would be appropriate in the opinion of the managing Committee. .
E. Where it is contemplated to remove any member under the above clause 6(C), regarding such proposal he/she shall be served a notice in writing and he/she shall have right to present his/her defence before the Managing Committee , and the decision of the Managing Committee shall be final and such member shall be bound by that.
F. The person whose membership is terminated from the Association, in any manner whatsoever, will loose all his interest of the funds or other properties belonging to the Association and will not have right for the water being supplied by common water tank or source for him having the membership of the association or for any other common amenities.

G. If for any reasons, the membership of the Association of any member is cancelled, then without prejudice to the rights of the Association, Association has right to take suitable action to recover all the amount due from such defaulted member. Till such amount is recovered and/or any person claiming under him, will not be entitled for using any common amenities provided.

6. Rights and Privileges of the members
A. The member shall have right to attend any Annual General Body Meeting and to exercise vote on any motion and will have equal right to contest to the Managing Committee or to attend the Annual General Body Meeting and exercise vote and shall have right nominate his husband/wife, parents or adult son to contest the elections to the Managing committee.
The rights and privileges of the members are equal. Though having any number of Apartment, every member shall have only one vote.
B. Whenever a member is admitted, every person shall be supplied with a copy of bye laws, free of cost. If requested for additional copies, on payment of such cost per copy or the fees that may be prescribed by the Managing Committee from time to time, shall be supplied.
7.Sources of Funds
A. Service charges: In respect of each of the Apartments, each member or his authorized repair sensitive, as the case be shall pay service charges or fixed service charges, this amount will be reviewed temporarily by the Managing Committee or the Secretary and it will come into effect only after obtaining the approval by the Managing Committee.

B. If any member of the Managing Committee absents himself for three meeting of the Managing Committee meeting continuously without any valid reason, his membership of the Managing Committee shall stand cancelled automatically and the vacancy so caused could be filled in, by the Managing Committee. But the member whose membership has been so cancelled, shall be given an opportunity to present himself before the meeting and adduce explanation and if found satisfactory, he may continue as the member of the Managing Committee.
C. The day to day administration, maintenance of the Alpine Eco Apartment Owners Welfare Association and all power required for the discipline shall rest with the Managing Committee.
D. All the questions that come up before the Managing Committee shall be decided by majority of members present and if there is equal votes, the President shall have second vote or the casting vote.
E. The Managing Committee can delegate any of its powers or for any special purposes may constutute sub committee consisting of members of the Association whom it deems fit. The sub-committee so constituted, shall be governed by any regulation that may be stipulated by the Managing Committee, from time to time.
F. Co-Option: The Committee shall have power to co-opt two persons amongst its members or from their families. The term of office of the members so co-opted, shall be coterminous with the Managing Committee.

8.Utilisation of Funds
A. With the prior approval of general Body Meeting, the amount collected shall be
utilized for the following purposes:-
1. For the payment of salaries of the employees of the Alpine Eco Apartment Owners welfare Association and Service Providers(if any)
1.Electricity charges for the lifts and common lighting and pumps.
2.Gardening and maintenance of landscaping
3. Building Insurance and maintenance, contract of lifts and pumps, generators etc.
4. Stationary, postal charges and related office expenses.
5. Day to day maintenance of building including consumable articles.
6. Building security contract and cleaning contracts.
7. Expenditures as approved by the Managing Committee.
8. Library or Annual Subscription of dailies, magazines etc.
9. Annual Maintenance contract of lifts after the period of 12 months on proportionate rate.
B. The amount remitted to the Maintenance Fund Account, with the prior approval of the Annual General Body Meeting shall be utilized for the regular maintenance of major nature, as hereunder
1.Painting of common areas and it may consist of surface of the outer wall and roof of the building.
2. Changing of water pumps, elevators and motors.
3. Reworking of the Landscaping, in a big way.
4. Repairs/Replacements required for the railing of the common area.
5. Repairs/Replacements of the covers of open shafts of the roof.
6. Repairs/Replacements of the covers of the drainage shafts.
7. Repairs of Drive ways.
8. Any other expenses ,that may be considered as maintenance by the Managing Committee.
C. The amount accrued by other charges levied by the Association, shall be utilized for augmenting the service charge fund.
9.Maintenance Fund
A. As decided by the Annual General Body Meeting every member shall pay such amount to
Association as maintenance fee and the said fund shall be the corpus of the Association. As and when decided at the Annual General Body Meeting all the members shall pay amount to
maintenance fund, as subscription. Apart from this out of the amount collected as Service
charge 15% shall go to the maintenance fund. Further the Annual General Body Meeting at
any time may charge the rate of subscription for any period.
B. Transfer Fee
Whenever the owner sell the apartment or completely alienate it by way of gift ,will or in o
other way whatsoever, the purchaser of the building or the recipient by way of gift,
automatically becomes the member of the association and he shall pay an amount by way of Transfer
fee to the Association as may be fixed by the Managing Committee from time to time.
the purchaser/recipient by way of Gift/who took by will has to pay the service taxes
applicable to a member, in these Bye laws

C. Date of Payment
1. The schedule for payment shall be as scheduled by the Managing Committee with the prior
approval of the Annual General body Meeting.
D. Mode of Payment
1. All the payments to Alpine Eco Apartment Owners Welfare Association shall be made in
cash or by way of crossed cheque/DD payable in the name of the Association.
2. Every owner of the building shall have a pass book and it shall contain the entries pertaining
to the amount paid towards maintenance fee, transfer fee and the amount paid as penalty
per month during the continuance of default. It the period of default exceeds more than three months, such defaulter, after completion of the said three months period, shall be deemed to have forfeited the right of amenities provided to him, for the reason of he being the member of the Association.
3. Except for the regular service charges for the amount payable for every Apartment, bill shall be issued. If the apartment is being used, the bill shall be issued to the owner, if not will be sent to last
postal address available with the Association. The Association shall maintain Proof for having
dispatched.
4. If a member fail to pay the regular service charges for a period of more than three months,
without prejudice to its right to recover the arrears, it will be lawful for the Association to
stop amenities including the water supply to the Apartment.
5. The occupant of the Apartment, will be responsible for paying all the arrears of the
Association.

10.Investment of Funds
Subject to the provisions of the Karnataka Registration of Societies Act, 1960, the Managing
Committee may invest the amount remained, as it deems proper, from time to time.
11.Bank Account
A. As decided by the Managing committee, shall open a Bank Account in the name of the Alpine Eco
Apartment Owners Welfare association in any of the Nationalized/Private/Co-operative/Schedule
Bank and the amount of the Association shall be remitted in such Bank and whenever the amount
is required for the works of Association, maybe drawn with the Joint signatures of the General
Secretary and the Treasurer of the association.
B. The Administration and Accounting year of the Association will be from the first of April till March
thirty First.
C. The Managing Committee shall appoint an Auditor and he shall not be the member of the Managing
Committee.
D. By appointing an Auditor the Assets and Liabilities of the Association, the Accounts of the Association
has to be prepared and the same shall be placed before the Annual General Body Meeting.
E. If any details regarding the Accounts of the Association, is required, any member can obtain the same
from the President or the General Secretary.

12. Obligations of the Building Members
1. Owners of every building shall be responsible to pay the arrears to the Association.
2. The members shall not use the Apartment other than the purpose of dwelling or in a way that cause breach to the privacy of other residents, in the opinion of the Managing Committee or in a way violating the honor of the building.
3. The owners of the shop premises shall not use their premises for any commercial activities in a way causing trouble to the residents. In this regard, the decision taken at the Annual General Body Meeting is final and the owners of the shops are bound by that.
4. If failing to undertake such work, if it could cause harm to the structures pertaining to other Apartment of the building, all the inside maintenance and repair works shall not be under taken secretly.
5. If due to the non performance of any obligation, that are to be performed by the member, any damage is caused to the common amenities that were provided in the building by such lapses, then in such a circumstances, the Association shall have right to undertake the required repairs and such expenses towards the repairs had to be reimbursed to the association, by the member.
6. At any time, whether the owner is present or not, in case of an emergency that has happened in that unit or that may cause trouble to it, the occupant shall give the right of admission to the Apartment to the members of the Managing committee or any other person authorized by the Managing Committee.
7. The member or the occupant shall not conduct/shall permit to conduct any activities which are detrimental to the interest of the co-occupants.
8. The owner/occupant shall not store/shall not permit to store any dangerous or objectionable materials that would ruin the peace and tranquility around the building or dangerous to the structure or construction of building.
9. The parking space shall be used only for parking vehicles of the members or the persons who have obtained power from the members as far as his parking space is concerned. The parking of vehicles is prohibited in the premises abutting it or for any other purpose.
10. Without the prior permission of the Managing Committee, any owner of the apartment or member of the association shall not undertake any repair, changes or modification of the space mentioned hereunder.
11. The works of changing the existing structures or that would cause damage to the apartments.
12. Any works that would cause damage to the building immediately or in future, in any way.
13. The works that would cause impediment to the common areas of the building or for the common amenities.
14. All major repairs to the Apartments has to be undertaken only after obtaining suitable approval from the Managing Committee or its authorized representative.
13.Common Areas and Amenities
The following Areas and Amenities in the building shall be deemed to be common to all members.
1. Staircase and stairways of the whole building.
2. Service road to the building and various Apartment.
3. The doorways and all open spaces inside the compound of the building.
4. Television cable network along with booster or dish antenna.
5. Bore wells along with motors, pumps etc
6. Elevator, pent house with respective elevator instrument on the roof of the building.
7. Elevator extended to the remaining stairs from the ground floor.
8. Water Tanks on the roof of the building.
9. Pumping equipment and plumbing network throughout the building.
10. Lights and water connections in common areas.
11. Electric wiring network throughout the building.
12. Required light, phone and water connections.
13. Basement, main walls, columns, girders, beams and terrace, gardens, pump houses of the building.
14. Vacant place and Landscaped space, garden and the rooms in it. Tank, pumps, metres, fans, fire extinguishing equipments, compressor ducts, central air conditioning and heating equipment and installations that are meant for the common use.
15. One Room for the use of generator.
16. Drive way at the entrance of the building.
17. Water processing plant and room, Association room and all oher common amenities/benefits.
18. Inter com equipment and network in the whole building.
19. Basement drive ways to parking bays.

14.Code of Conduct
1. Unless empowered by the Association no residents shall affix any kind of Advertisement or posters in or over the building.
2. The residents who rear pet and domestic animals shall follow the law, rules, regulations of sanitation of the Municipality. Without accompanied by some one, the pet animals are not allowed to go out. The cleaning excreta of the pet animals is the responsibility of its owner.
3. Putting garbage by the residents of the apartment outside the area earmarked for such purpose in the service area, is prohibited.
4. All the residents shall extend their co-operation regarding the security and protection of all the concerned and shall be bound by the Rules and Regulations framed from time to time in that regard and shall be in accordance with it.
5. All the residents shall use the water limitedly and shall not put the cloths for drying ,in common areas.
6. None of the residents shall use the services of the watch and ward staff and other employees of the Association, for their personal work.
7. It is suggested that the residents shall not have a quarrel with the employees of the Association /service Providers. If there are any complaints against any such employee/Service Provider ,shall bring such matter to the notice of the Secretary or any other persons specified by the association. He then will conduct enquiry and take necessary resident action.
8. The residents shall prevent their servants roaming in the common area or quarreling with other residents. All the residents shall be responsible for the conduct and discipline of their servants and except the common servants toilets provided in the building, the servants shall not use common amenities provided.
9. The residents, their family members, guests or children shall not play within the compound of the building, the reason is that there is likelihood of sputniks or other flying articles hitting the window glasses, cars, scooters or causing injuries to the persons.
10. The expenditure of damage caused to the building ,plants, vehicles, equipments or machines, pipes, electrical wiring by any negligence or willful act of the member or his family members, guests, children or servants, shall be paid by the member to the Association.
11. There is no provision to park the vehicles of the visitors inside the building.
12. Generally, shall conduct themselves in a way having good relationship with the members/residents, the neighbourers of the residents of Apartments and shall be a model of courtesy.
13. With the prior written permission of the Managing Committee, except on the special occasions like festival and marriage, no music be played in the common area and not to litter in the common area.
14. The residents shall be bound by the rules that may be framed from time to time by the Managing committee regarding the using of common amenities/utilities.

15.Amendment to Bye Law
For any Amendment to the bye law or regulation, when 2/3 member give their consent when tabled before the special General body Meeting , will have power to frame or alter not inconsistent with these and after the consent of the Register of Societies, could be adopted.
16.Time Limit for Notice by the member
A. The Members who intend to give notices regarding the proceedings of the Association and suggesting Amentment to the constitution, shall send the notice to the office of the Association at least 10days before the day fixed for the Annual General Body Meeting.
B. Preparing the Next year Budget Estimate, by the Managing Committee.

17. Quorum for the General Body Meeting
In every General Body Meeting Not less than 1/3 members shall be present. If in any meeting if this requisite number of members are not present within half of the stipulated time, that meeting shall be adjourned. Thy day, time of the adjourned meeting shall be fixed by the president and shall be intimated whether there is quorum or not. No new agenda shall be taken up for discussion in the adjourned meeting.
18. General Body Meeting
A. 21 days before the convening of the meeting The General Body Meeting shall be held within 03 months after completion of Financial Year i,e., within June month every year. Notices shall be sent to every member.
B. The Income and Expenditure Statement for the previous year prepared by the Chartered Accountant shall be discussed at the meeting and approved. The Association will review the progress achieved in that year.
c. Every year, in the General Body Meeting 07 number of Managing Committee members shall be elected. These elected members will elect president, Vice president, General Secretary, Joint Secretaries-2, TREASURER, Deputy Treasurer and Managing Committee Members amongst themselves and other will continue as the members of the Association. Presenting the budget for the next year.

19. The power of the member to exercise vote and become candidate
1. Only the members who have paid their subscription amount in full and whose names are included in the voters list will have power to participate in election to General Body Meeting and the Managing Committee.
2. THE VOTING IN THE General Body Meeting may be held by raise of hands or by secret voting, Every member who is present or the representative who is personally present will have power to exercise one vote only. Even if a person owns more than one Apartment, he will have power to exercise only one vote.
3. The member, himself can exercise vote being personally present or the representative who has been authorized by the member can exercise vote. The document appointing the Representative shall be in handwriting of the person who has appointed and shall be specific for every meeting.
4. If in respect of any Apartment failing to pay the service fees from time , other arrears ect as provided in this or any other amount due to the Association, till that default continue, the representative representing that villa, will not be having power to exercise vote .The Managing Committee may display the names of such members on the Notice board.
20. All decision shall be done by the majority of the members present. In case the amendment of the constitution of it the majority shall not be less than ¾ of members present.

21. Special General Body Meeting
Whenever the Managing Committee deems fit, it is necessary or whenever not less than 1/3 member eligible to vote request or on the order of the Registrar of Societies, within 30 days from the date of requisition , Special General Body Meeting shall be convened by giving at least 21 days of Prior to all the members. In the notice the place ,date time and agenda shall be mentioned. For the sole reason that some one had not received notice, the proceedings of the meeting, will not become void.
22. As soon as the year ended, the President, Secretary shall prepare Annual Accounts and get auditor duly authorized as per Section 296 of the Companies Act, 1960 and place before the General Body Meeting.
23. As per Section 13 of the Karnataka Registration of Societies Act, 1960 within 14 days of obtaining permission of the Annual General Accounts shall be sent to the Registering Officer.
24. Amendment
Taking action as per Section 9 and 10 of the Karnataka Registration of Societies Act1960, if necessary the Memorandum and the Bye Laws of the Association could be changed. Such Amendment will come into effect after obtaining permission from the Registering Officer.
25. Dissolution
By taking action as per section 22 and 23 of the Karnataka Registration of Societies Act, 1960, the Association could be dissolved.

26. Affiliation
By taking action as per Section 21 of Karnataka Registration of Societies Act 1960 may be amalgamated with any registered Association.

27. Power and Duties of the Office Bearers President
Will have power to convene all the concerned meeting, to convene Managing Committee to give guidance and supervise the business pertaining to the Association, to exercise casting vote. Will have power to convene Managing Committee Meeting in Special Circumstances.
Vice President
Assisting the President, in the works of the Association and in his absence perfoms the duties of that day.
General Secretary
The General Secretary will convene Managing Committee Meeting , Annual General Body Meeting and other meeting of the members, Will correspond with private, government, semi government organizations and the concerned department regarding the subjects decided at the Managing Committee. Recording the proceeding of the meeting, get the Accounts written, receive the proceeding of the meeting , get the Accounts written, receive the subscription , donation and gifts from the members, donors, private persons, government and semi government organizations.
To look after the financial transaction of the bank, to see that the accounts of Association are got recorded at the Register of societies from time to time every year and correspond with all the concerned department on behalf of the Association and after court, office affairs.

Joint Secretary
Receiving the General Secretary in the day to day affairs of the Association and in hs absence performing the duty of that day.

Treasurer
Receiving subscription, gift, donation, etc from the member, donors, organizations and issuing receipt to them. Remitting the amount so received to the Bank and handing over the receipt thereof to the President or General Secretary of the Association
28. General
A. The Singular used in this Bye Laws and Regulation shall include plural also and plural shall include singular also.
29. Regarding the provisions not specifically stated in these bye laws. Provisions contained in the Karnataka Registration of societies Act, 1960 and The Rules made there under shall apply.
30. Notice Board
The Association shall put up Notice Boards in front of the office and at the Main entrances of the Apartment for displaying the meeting notices, resolution, proceedings etc such notice board shall be deemed sufficient for serving of the notice.
